Can't create new art brush (pen tool)

For what ever reason I can't seem to create new art brush for pen tool.

this window pops up but cant select Art Brush...

Oh ok.... I had to select the stroke that I wanted to make a brush...

You don't appear to have anything selected. Select the object you want to use as a brush first.

Select the object, then select New Brush from the Brush paanel menu.
