Closing a menu within an action

I'm trying to create an action that includes having to Insert Menu Item for the Transform Each panel to open. It works great except that the action stops until OK is hit on the panel. As my goal is to Batch run this action I don't want to stop to hit this button each time. Is there a script or action that would automatically close this?

Are you going to use always the same Transform Each settings?

Yes, I make not changes to the Transform panel when the action opens it, I just need to hit OK to move on.

Then you can just record the action without using the Insert Menu Item command.

Make sure that the modal dialog is disabled in the Actions palette.
