Save the file in eps10

Hello!

I want to save the file in eps10. I write commands

var newFile = new File("j:/1.eps");
var saveDoc;
saveDoc = app.activeDocument;

var saveOpts = new EPSSaveOptions();
saveOpts.compatibility = Compatibility.ILLUSTRATOR10;
saveDoc.saveAs( newFile, saveOpts );
eps is saved but not in version 10. Unable to save in eps 10?!
