Hey, why isn't the background layer above the penguin? It's not working for me and I don't know why - I tried to make it like the tutorial I watched on YouTube.

please help

What exactly do you want to achieve? I can see several layers in the layer panel. Your artwork is on the “Drawing” layer in your third screen shot. If you want to go by the naming in the tutoiral you could double click the name “Layer 3” to rename it to “Background”. Then you would have to add a rectangle to that layer which is present in the first screenshot. This rectangle will be on top of everything.
