Polygon Tool won't go in paths.

Whenever I use the polygon tool, it for some reason always gos to layers instead of paths. When I delete the layer, it also deletes it's path layer, if I also put it in paths. Any way to fix this.

What are the Tool’s settings in the Toolbar? 

Could you please post screenshots with the pertinent Panels (Toolbar, Layers, Options Bar, …) visible?
