Why is the 'Use legacy New document greyed out in preferences, now I have updated photoshop?  I would like this window back

@JoHorne can you post your Photoshop system info, in Photoshop go to Help > System Info, hit the copy button and paste the entire thing into this thread

In addition to what Ged said, can you show a screenshot of your Preferences panel where "Use Legacy 'New Document' Interface" is grayed out?

Hi sorry I didn't reply I have been away for work without the laptop having the issues.  I've returned and it's fixed, it is no longer greyed out and the 'New File' is behaving as though nothing happened.
