Cut by layer

Could not make a new layer from the selection because the selected area is empty?

Every time I try to cut by layer it gave me that error. Can some one help me to fix this issue. I'm kind off new using photoshop.

Make certain that you have the correct layer selected.

Hi

Your layer call "Top" is active and I can't see any pixels on it. If you are trying to make a new layer from something on the Background layer, select that layer first.
