Issues with select subject in photoshop 22.2.0

Hello if some one can please help, im having issues when selecting subject, i keep getting this error. im on the new M1 Mac mini and even tryed insalling older versions of photoshop but still having the same issues

You probably have a layer above that is selected instead and in that case Ps cannot find the subject; Check the layers panel and select the one with the subject

Yea its very strange, im not having this issue with the beta version of photoshop, only with this version the only reason im not using the beta version is because quick eport PNG isnt working properly, heres a screen video i did you can see.

Also are you using the new M1 not sure if this is an issue.
