on empty layers no colour picker with the brush tool

Photoshop 2021  22.2.0

On empty layers the colour picker stopped working with the brush tool. This happens with both the Wacom pen and the mouse.

This bug occurred after the bug with the program error when saving was fixed.

Is this the farewell to a once great programm?

Go to the eye dropper tool first and set "Sample All Layers". Then switch back to your brush and try again.
