Incorrect data after transferring account from fotolia.com

Some time ago I purchased licenses on Fotolia. Now a law firm has contacted me for compensation for unauthorized use of photos.

 

So I transferred my account from Fotolia to Adobe Stock to show as proof in the case that I legally purchased licenses for these photos. The problem is that after the transfer, in the historical licenses I have the transfer date, not the date of purchase of this license.

 

For this reason, they reject it as proof and claim that I purchased these photos after their report.

So please help me change the dates on my account or send any other confirmation showing the date of purchase of the photos on fotolia (and not the date of transfer to Adobe Stock).

 

I tried via chat but after 4 redirects the chat simply ended by itself and I was left without help...

The license history will always show the transfer date. I think that is by design, even that I do not find it very lucky.

BTW: there is a reason, why I tend to keep tose documents with me.

 

If you still have the original asset, check the exif data. They should show Fotolia as the stock agency. As Adobe has switched off the Fotolia site some years ago, it would not be possible to licence now an asset from their site. 

 

Check also, if the contributor and the asset is still on the stock site. If it is not, it could not been licensed now. If it is, ask them if they have asked Adobe, if you have a licence. Before taking action against stock customers, they need to check this with Adobe.

 

(and BTW: having someone claiming something does not mean that they have the right to do that.)

It is my responsibility to prove that I have the license legally and I currently have no way to do so because the date of account transfer appears, not the date of purchase...

 

I have the original file with EXIF ​​data. Thanks for advise. The question is whether the court will accept it as evidence...

You are at court? Well, if the other side is a bit intelligent, they will accept that. And I would ask the other side also to prove copyright ownership and for documentation that they contacted Adobe and the information that Adobe confirmed that the asset is unlicensed. 

 

Check for the terms and conditions for contributors. I think that I have read something like this in those terms.

The claims are for #48500453.

But if it is possible ("just in case") I would prefer a date update/confirmation for all transferred from fotolia 🙂

I'm not a lawyer, but things like this rarely land before court. And my gut feeling is that if the other side feels that you may have rightfully licensed the assets, they will back down. It's about making money, not about principals.
