I would say that the first image isn't visually pleasing and it wouldn't have a very good chance of being sold as a stock image.

The second issue might have an issue with exposure and noise.

1) blurry (subject movement) and leaning horizon

2) blur, leaning horizon, white balance issue

In addition, the second photo is very noisy.
