Discovered someone pirating my images

I recenting found a user on Adobe Stock that has been downloading my images from the midjourney gallery and selling as their own stock images. I have been reporting them one by one, but this person has TONS of images (75+ pages) at least 20 images from me on the first 4 pages and  I want to know if there is a bulk way to report things.

 

I have just set my midjourney account to private (stealth), but had to upgrade to the $60 a month account to do so.

 

I discoverd this by searching for one of my own images to see how the results worked with certain key words and  the other users version of my image ranked higher than my own. I am also not totally sure how to proove this except I have the link to my created mid journey image. Other suggestions?

That's the disadvantage of using a platform in a public setting. If Midjourney allows letting others get inspired, or even copying the prompts, then it may not technically being pirating.

 

There is no bulk way to report that, and the reported person could also argue that you were the one copying... 😉

True, except that the OP has proof that they created the asset on their Midjourney account. The perpetrator would not. In the end, I suppose it's whether Adobe wishes to pursue the complaint and to what extent.

What the offending user did was very shady.  But sadly for you, you have no recourse.  You failed to protect yourself from the onset and left yourself wide open to public exploitation.  The damage is done.

To file a "Take Down" complaint, you have to prove they stole your assets.  You can't prove you own them because they were in public view.  Do you see the problem?  It's your word against theirs, and Adobe Stock is in the middle.

 

If I were in this situation, I would remove my public Midjourney assets from Stock.  And then start over.  I know this is not the answer you're looking for. But it's the only way out of this mess.

Thanks for all the replies so far.

 

It's not a case of using a prompt its exactly the same image. As the images are automatically added to the gallery for "inspiration". I will have to dig a bit more into midjourneys use rights when things are in the gallery.

 

When users upload to adobe stock they do have to confirm they created the images. So I belive that is an infringment of Adobes agreement, but we will see. I will post when I hear back from Adobe, wanted to give them a chance to reply before outting the other persons profile, but based on the image range they have its likely they have been doing this to a lot of other midjourney users.

No.  Stock Contributors must ensure they have appropriate rights to submit AI assets for commercial use.

According to Midjourney, free users cannot use images for commercial purposes. Only Pro & Mega plan members can use images for their business.

 

Even with Stealth Mode turned on, any images made in public channels on Discord or rooms on web are still visible to others.
