You sure the top one at least isn't AI rather than a photo? Viewed even at 200%, it becomes mush.

They are overprocessed cell phone pictures. So yes, they are photos.

Both are over saturated and it appears that you've applied some sort of filter in post processing.

Your equipment is working against you, not for you. 

If possible, turn off all automatic camera features.  Or start saving for a good entry level DSLR camera (new or used). 

 

The second photo is underexposed (too dark) for commercial use.
