Somebody is using the same prompts as me and copying my portfolio.

Hello, I already filed a DMCA but did not recieve any confirmation email from Adobe. Is this normal? How long does it usually take to process a DMCA? Can I do anything else about it?

How would someone be able to copy your prompts? Have you published them somewhere? Does the user agreement for the AI Generation tool you are using state that you own those prompts?

Well Adobe themselves in the Insights tab are encouraging people to look at successful profiles and if those are AI profiles and someone just starts copying that is OK? Doen's sound right to me. The images are not just similar like I'd mistake them for mine.

The images displayed on the Insights tab do not give anyone a hint as to how to replicate the asset. While other Contributors or Buyers can view the titles in such assets, we can't see the keywords used, nor, of course, the prompt. Anyone can try their hand at mimicking the content or style of an image they see anywhere. You can go to Facebook, Instagram, Flickr, SmugMug, 500px, Stock sites or any online source of imagery as inspiration for your own work. Doing so does not constitute "image theft" unless you download and claim the image as your own.

AI generations and AI prompts can not be copyrighted. In any case, the same identical prompt will generate an entirely random and different set of images. In any event, if you don't want people copying your prompts, pay the extra $20 a month or whatever it is that Midjourney charges to make your generations private. Prompt sharing is common, if not encouraged, though experimenting with variations of a prompt other than using one verbatim is considered a more ethical approach.

I don't want to provide examples but I'd mistake their work for my own - that is how similar it is. And it is not one picture they are copying my whole portfolio it seems. Also I shared the story on my YT channel today without naming the copycat and recieved a threat in my email that I should reconsider my DMCA otherwise my portfolio doesn't last long.

When you say "similar," do you mean similar from a stylistic standpoint? Or are the images so close to being identical that it's as if the individual is taking your images and re-editing them ever so slightly as to hopefully avoid detection? It's really difficult to be of help without seeing an actual example.

OK so if you promt "pastel color Easter eggs pattern" it will give you different results with each generation and seeing the image you will not recognize it was from your promt as it is generic. Prompting "photo of black French bulldog close up with a golden crown sitting on a pastel purple and gold velvet throne on a pastel purple background" will give you a very specific recognizable result. Although lets say the idea is not super original it is very specific so the images will indeed look more or less the same

There has been a lot of debate about whether it's possible to own the copyright to an AI image.  If you are willing, let us know the outcome on this.  This may be the first post about this on the forum, it's certainly the first I've encountered

 

From my understanding, the user with the alleged violations will have their account temporarily suspended while Adobe investigates this.  In my opinion this isn't clear cut and will take some time for Adobe to decide.

So you guys!!! The copycat account seems to be deleted. Adobe wrote they deleted the image examples I provided but I cannot find the whole portfolio.

They might have temporarily suspended the account pending an investigation. Assets are taken offline while an account is suspended.

Good luck for now. But you're lucky they didn't temporarily close your account too, I mean they usually close both accounts. But as others write, both prompts - and the images - are in fact public domain. But understandable not at Adobe.

Your claim, if basically founded, will lead to a suspension of the account. So between «did not receive any confirmation email from Adobe» and a deleted account, there was not a lot of time. They seemed to react quite fast. 

 

If they find that the account holder did indeed copy your assets, they will terminate his account. Even if prompts can't be copyrighted, posting images here that are yours is most probably against the terms of the contributor contract.

Best solution in MJ is pay extra for max privacy.  Second best solution in MJ is to not produce your work in public rooms.  Create your own personal server and set up your own channel.  The latter isn't perfect as your results are still searchable but your work isn't as easily observed.
