Reporting Copyright Infringement of Adobe Stock Licensed Images being sold as NFTs (Cryptocurrency)

Cryptowriter (The Writer Company, writer.io) and their COO, Sean Ballent, along with one of their writers, (Thomas Dylan Daniel) created a set of fraudulent NFTs for sale on the Atomic (WAX) platform.  They are currently up for sale despite multiple warnings of fraudulent activity and legal ramifications.  Some have already sold.

This is blatant copyright infringement as these are not to be sold for resale per a standard license, which I know is all they have.  They seem to think it's funny to steal your work and sell it to people under non-whitelisted (fake) NFTs.  I don't find it humorous.

This person was warned several times.  The company is now condoning this behavior.  Fake NFTs are a constant problem with the current cryptocurrency boom, and this is exactly why.

 

These images were intended to be headers (branded for the company) for article titles.  Instead, Thomas Dylan Daniel took a copy of Sean Ballent's branded image and minted it as an NFT (Non-Fungible Token) for sale.

I prefer to remain anonymous.

I worked for the company until I found out this was happening and quit immediately as I will not be associated with their illegal and immoral behaviors.

As I was independently contracted at the time, I was a licensed member of the team per their Adobe Stock Account, and I made many branded images (legally, and not for sale) while working for the company.

For this reason, I cannot submit the DCMA form because I am not the current rights holder.  I will keep in touch for further action.  I'm a front page Cryptocurrency writer and this not only broke the law but put my reputation at stake.

Being in cryptocurrency, I operate pseudo-anonymous.  This is normal, and you will likely see more of this in the future if you have not already.  I am now licensed privately and happy to abide by your conditions legally while doing my own graphic work for articles.

If there is a way for me to continue the DCMA without being the active rights holder or representative of the rights holder, I will do so.

 

However, the evidence is there for you to see clear as day.  The NFTwriter logo in the corner and the King of Leon album in the center were imposed on an Adobe Stock Standard License Image.  This was admitted by the accused.

I did everything I could to get them to take this down without filing a report, but they refused after I had resigned from the company.

Please let me know how to proceed.

I would recommend submitting the form anyway even if not the rights holder. We have a formal process for a reason and it will then allow Adobe's team to investigate. You have the pertinent information and are the only one that can answer any outstanding questions. Without a formal complaint there isn't much we can do.

Consider it done.  This type of behavior hurts writers and cryptocurrency as a whole.
