How can they charge local tax on subscriptions for Canadians when charged in US currency?

Whenever I purchase something in the US, I'm not charged tax but do pay US dollars. The subscriptions are based where the product will be used which I get so tax is applicable but how can it be charged in US dollars. There's no such thing as HST or GST in US dollars. Has anyone checked it out with local tax office? Is it legal?
