Real estate Property Release Agreement

If a new construction home is photographed with staged, furnished interiors, and a release is obtained form the developer/owner,  is a property release required from the buyer, as the home will be delivered empty and unfurnished?  Thank you-

A property release is required from the owner of record. If the buyers haven't taken title to the property yet, they have no property rights yet.

Imagine what that would be a mess, if every new owner of an item would need to agree on the use of your photographs. As a side note: a room is defined by its form, like where and how the windows are located, but also by its furniture.

If the developer or owner provided a property release for a staged, furnished new construction home, a separate release from the buyer is not typically needed—especially if the buyer hasn't taken possession yet. For similar situations, see how it's handled in rental property management  practices.

The owner at the moment provides the release, regardless of the situation before and after. The only one still having rights in this is the architect, but for being able to claim those rights, the building needs to be more than a classic house with a roof.

Just to addonce the buyer takes possession, future use of interior photos might get tricky, especially if the images could imply current ownership or decor. It's always safer to limit usage to marketing materials created before the sale is finalized, unless new permissions are secured Read more .
