Media encoder supports/allows users to use h.265....is that legal?

So I know that there are (or maybe now its "used to be") royalty fees for using the h.265 codec.  Is it okay to use the h.265 codec, or will I get sued/slapped a fine for using it to compress for the web/youtube?
