Using Adobe stock in Podcasts

Hello,  I have searched endlessly for days and have not found any actual answer to this question. Can you use Adobe stock audio standard license (the only license available for non enterprise users)  in podcasts?  Please don't link Adobe licensing terms as I have read through them numerous times and there is no answer, podcasts are never addressed as far as podcast specifc use.  They just give podcast as an example of linking audio to an image or other asset.

While searching I did find numerous Adobe content advertising the use of their stock audio for podcasting and how easy it is, even a page from Adobe directing you to their stock audio to use for podcasting, even recommended clips.  But nowhere does it actually discuss whether it is legal to actually use the audio in your podcast.

The standard term States "

h Adobe Stock’s royalty-free audio licenses, you may use any licensed music track as many times as you like, for as long as you like, anywhere in the world.

The Audio Standard License covers most common uses like social media, websites, digital ads and corporate presentations, except those listed below.

The Audio Extended License is required for projects which will be distributed via:

  • TV or Radio
  • Paid-access on-demand or streaming video
  • Apps or Video Games
  • Theatrical releases
  • Physical Point-of-Sale Locations

Restrictions for both Audio licenses:

  • Audio files must be synchronized with picture, narration, etc. No stand-alone distribution. The audio file must not comprise the primary value of the end product.
  • No remixing, mashups or other alterations for the purpose of creating a new music track. Only minimal modifications are allowed.
  • Audio files cannot be incorporated into templates, logos, or other corporate branding.

nowhere are podcasts actually addressed, just left for interpretation and my interpretation would be they are perfectly fine for standard license, especially since Adobe is pushing the use of its stock audio for podcasting via marketing.   And if an extended license is actually required then only enterprise clients have access to extending audio licensing.

So why would Adobe be pushing marketing to normal individuals and offer standard stock audio examples for use in podcasting via their marketing.  They can't expect everybody will become an enterprise user.  The marketing isn't even geared at enterprise level users, it's geared at individuals.  And I can't imagine them offering this to just trick people into using the audio so they can in turn sue them lol.  They have whole articles written on how easy it is to use their stock audio for podcasting but no discussion at all about licensing.  It all seems very misleading.  Kind of like how Adobe Express actually has a logo maker program but according to adobes terms it's illegal to use any logo created within Adobe Express. But that's another discussion.

Anyways, if anyone actually can offer a definitive answer on whether or not you can use Adobe stock audio in podcasts it would be greatly appreciated, as it seems rediculous that I would have to hire a lawyer to find out simple information like this.  Thank you.

Look at the licensing terms as your friend, not as your adversary.

As the podcast does not fit the need for an extended licence, you can use it for what you intend to use it, by respecting the restrictions.

Look here for more information on licensing: https://community.adobe.com/t5/stock/links-for-licensing-terms/td-p/11366788
(Disclaimer: As always with licensing, this is my interpretation of the rules. I think they are correct and advice is based on reading and interpreting the licence terms and on fair use for both the buyer and the artist/stock company, but I cannot rule out that my interpretation is wrong. I'm not an Adobe employee).

You're welcome. BTW: Adobe never answers licensing questions, they point to the licensing terms (those you read) and ask you to consult a lawyer specialised in that matter. But you always should convince yourself, that stock has been designed to be used. Applying common sense helps a lot to answer the questions.
