  Why do I need a release form when this person can't be recognized?  He's a silhouette and his back is to the camera.  Any opinions?

You should not need a release for this image. I can see that the image is quite noisy, so perhaps the moderator selected the wrong rejection reason code.

Not much you can do, as there is no way to appeal the moderator's decision. Is this the uncropped image as submitted? If there's more to the image that it would still be interesting without him, remove him and resubmit. I know...that changes the whole concept of the image and might make it pointless, but you/re left with very few options. Or maybe try some gen fill and replace him with another silhouette, then submit as AI generated.

Also, what @Jill_C said. There could be other issues, unless you specifically received a property release requirement. Could be your image was moderated by someone new to the job and was being overly cautious. Maybe wait a month and re-submit?

You do not need a release for that picture. If the moderator did ask for one, they either selected the wrong refusal reason, or refused by error, depending on the overall quality of the asset.

Try submitting something else.  Good photos begin with proper lighting and camera settings.  Examine your images at 100-300% magnification.

 Correct errors if you can in Photoshop or Lightroom.  Discard the ones you can't fix.

 

Adobe Stock customers expect the highest visual and technical quality for use in commercial projects. 

This is not commercial quality.  That's why it was rejected.
