Substitute Captivate 4 Player

Greetings,

Our contract w/ an eLearning contractor is nearing it's end. They used Captivate 4 to build software sims. It appears they modified the Captivate swf player(s) to include their company branding. Under the contract we are not allowed to continue using that branded player w/o paying a HEAVY additional fee. Nor are we allowed to use their source files to rebuild the training ourselves.

My question is: is it possible to substitute standard Captivate players for the branded one(s) so that we can continue using the products we purchased w/o violating their branding? And if so what would it take?

If they were smart enough to modify the playbar to include their branding then they were probably also smart enough to embed the player inside the main SWF file rather than have it externalized.  So, I'm thinking you are probably NOT going to have any option here but to rebuild the course if your want to get rid of that branding. 

In future, make it a condition in your contract that you ALWAYS own the intellectual property and all source files are to be handed over on or before the end of the contract.  That's what most people do.

Thanks for your response. I did find within the package four player files: CaptivateMiniPlayer.swf, CaptivateMiniPlayer1X.swf, CaptivateMiniPlayer3x.swf and CaptivateMiniPlayerScrolling.swf. But on further review, their branding is so pervasive, I don't see how they could have avoided included it within actual course content, making it impossible to separate it from the content.

And you're right about the contract language. Not the way I would have liked it but then no one asked for my opinion. <g>
