  1. Can I use Photoshop to scale and crop the upper lower right and left sides by referencing the eyes of portrait photos taken at different distances. And after doing this process, can I create an action?

Yes, presuming a single headshot. An action can record the Liquify Filter – Face Aware command with adjustments made to the eyes. The difference blend between a copy of the liquified result and the original can then be used to create a rectangular selection around the eyes. The selection can then be transformed with a static or interactive modal step and then the crop from selection can be applied.

 

Results are variable and dependent on how well the facial aware liquify algorithm can detect the eyes. A similar topic on cropping based on the face can be found here:

@ömer33573743z3jk Photoshop cannot do actions based on contextual parameters (referencing the eyes).
