The tool is part of CS3 try resetting your preferences.  Do not deactivate CS3 if yours is activated.

You could try installing CS3 over your current install without deactivating it then install the CS3 updates  CS3.  CS3 is very old it can not be activated these days. Adobe did provide an install that does not require activation for old customers.  However, Adobe has removed that download from the web. It is no longer an option. CS3 Windows updates should still be available to be download  using this Photoshop Perpetual Windows versions updates

Could you please post a screenshot with the pertinent Panels (Toolbar, Layers, Channels, Options Bar, …) visible and the relevant Toolbar-fild expanded?

You are aware that it shared a place with the Rectangular, Single Row and Single Column Marquee Tools?

What have you done for trouble-shooting so far?

Restoring Preferences after making sure all customized presets like Actions, Patterns, Brushes etc. have been saved might be a good starting point:

Hi

Please right-click the rectangular marquee tool (or press and hold) and show a screen shot of the hidden tools that share space with it. It's circled in red in my screen shot.
