Legacy new document interface problem

I like the new 'new document interface'in Photoshop. However, Photoshop 2020 keeps defaulting to the legacy interface. I re-set it in preferences, and for a while I do get the new interface, but sooner or later, without me adjusting anything, it returns to using the legacy interface. It's not the end of the world, but it's irritating.

Have you tried resetting Photoshop preferences

    Yes, over and over again. When I reset the box by removing the tick, I get the new interface for a while, then it reverts back to the old interface - and the tick is back! I must have removed that tick more than 50 times! It never goes back immediately - it usually takes about a week or two to revert.
