Photoshop 25.1 not merging layers when clipped inside a shape

I have 2 layers on top of each other, both are clipped inside 3rd layer by using layer mask.

Now I select both layer 1 and 2 then the Merge Down shortcut : Ctrl+E does not work and it's greyed out in the Layers menu panel.

 

Is this a bug? please help

You can try re-creating this bug by simply apply a layer filter to the top shape and then try to merge the two shape layers.

This is how the Photoshop should behave>

When I merge two layers underneath a filter, they merged first then the top filter applies to the result of both layers.

Since there is filter clipped into the top layer I cannot merge the shape layers at all. Photoshop should have the flexibility to merge layers from anywhere, I mean 2 layers from different groups or underneath different filters and vice versa. 
Even disabling the layer filter doesn't help this bug.

The main problem is layers CAN NEVER be merged if they are  inside a hierarchy.

This should be fixed.

Can you post a screenshot of your layers panel and image?
