Saving as PNG - Sets as Background & Locks automatically instead of Layer

I haven't used Photoshop in a couple off months and had some updates. Theres a slight problem and It's causing a problem for me.

If I had a PSD that had no background and the layer had no transparency. When I saved it as a PNG and opened the file back up, everything would be on Layer 1.

However, since these updates. When I save the PNG down (On Layers without transparency) and open it back up, everything is on the Background and locked. I have also tried to create an alpha channel, but its looking like if there is no transparency, no matter what it will save as a Background and be locked.

Is there any way around this? When there is transparency everything is working as it should. I'm not sure how long this has been going on for, but I'm having to use another program to save the PNG's down to get around this as the textures I am creating are not loading up in the games when saved as a Background.

Use 'Export as' rather than 'Save as'.

Would this also work with Alpha Channels?
