The license was granted to the individual, according to the EULA, not to their employer. If it's a retail license you have no right to take it over, unless the ex employee completed the paperwork to grant it. If it's a subscription you can stop paying it (completing the year if that's the contract).

Also, when I worked in a company, someone in the central IT office kept track of all licenses... so a situation like you have couldn't happen
