Legality on using Firefly imagery created with child's face pictured

Firefly is becoming a useful tool for me to create visuals of my products (face paints) in use for my website and packaging. How do I stand legally when using these 'photographic' images which contain kid's or adult faces? 

 

Does this person exist somewhere and have given their permission, or is the face completely Ai generated and therefore not 'human?'  

 

Anyone have any insight? Thanks in advance

Thanks but this doesnt answer my question.  I gather I am free legally to use the images, my query is, do the faces created actually exist as humans.

You are asking two questions:

  1.  Are the images real people?
  2.  Are you legally free to use the images?

 

Are the images real people?

This is a technical question. The faces are not images of real people. They are created based on mathematical models of people's faces in training data (Adobe Stock images and public domain photos, per Adobe). It is possible they might look like someone who is or was a real person, but they are not an image of that person.

 

Are you legally free to use the images?

This is a legal question. The link @Vivek12  provided is what Adobe will say on this, which is the images can be used commercially (with some restrictions on beta releases detailed in the policy). If you need a higher level of assurance than what Adobe says in that policy before using an image in your application, I recommend you consult your legal counsel.

You do not require model releases to use images of any faces generated in Firefly unless you based that face upon a real person.
