6. Vivid details
People: Draw people and tourists cycling, exercising or enjoying seafood.

معاش و منحة التقاعد المنقول

معاش و منحة التقاعد المنقول يستفاد منهما ذوي الحقوق المؤمن المتوفي

1- المستفيدون من معاش الأيلولة
* زوج المؤمن المتوفي مهما كان عمره شريطة أن يكون الزوج عقد زواجا شرعيا مع الهالك

* الأولاد المكفولون (طبقا للمادة 67 من قانون 83 . 11 المتعلق بالتأمينات الاجتماعية المعدل و المتمم و هم :

الأولاد المكفولون حسب مفهوم التنظيم المتعلق بالضمان الاجتماعي البالغون أقل من 18 سنة.
الأولاد البالغون أقل من 25 سنة و الذين أبرم بشأنهم عقد تمهين يمنحهم اجر اقل من نصف الأجر الوطني الأدنى المضمون.

الأولاد الأقل من 21 سنة الذين يواصلون دراستهم
البنات بدون دخل مهما كان سنهم.

الأولاد مهما كان سنهم الذين يتعذر عليهم ممارسة أي نشاط مأجور بسبب عاهة أو مرض مزمن.

الحواشي من الدرجة الثالثة المكفولون
الأصول الذين كانوا في كفالة المؤمن له المتوفي عندما لا يكون الدخل الشخصي لكل واحد منهما لا يتعدى الحد الأدنى لمعاش التقاعد.

2- كيفيات الاستفادة
هناك حالتين :

وفاة المؤمن له و هو متحصل على معاش :على ذوي الحقوق أن يقدموا طلبهم للوكالة الولائية للصندوق الوطني للتقاعد و تكوين الملف الضروري للحصول على معاش
وفاة المؤمن له أثناء العمل قبل أن يحصل على معاش :ينبغي على ذوي الحقوق أن يتوجهوا للوكالة الولائية للصندوق الوطني للتقاعد لمكان المستخدم لتكوين ملف المعاش المنقول
3- مبلغ و تقسيم معاشات ذوي الحقوق
يقسم مبلغ المعاش المنقول بين ذوي الحقوق حسب النسب التي يحددها التشريع (المادة 34 من القانون 83/12 المؤرخ في 02 جويلية 1983 المتعلق بالتقاعد) حسب الحالات الآتية :

* الزوج فقط في غياب ذوي حقوق أخرين 75 ℅ من مبلغ معاش المؤمن له المنوفي

* الزوج + ذو حق أخر 50℅ للزوج 30 ℅ لذي الحق الأخر

* الزوج + ذوي حقوق أخرين 50 ℅ للزوج 40 ℅ لذوي الحقوق الآخرين تقسم بينهم بالتساوي

* لا يوجد زوج و يوجد ذوي حقوق أخرين

*90 ℅ تقسم بين ذوي الحقوق في حدود 45 ℅إذا كان ذو الحق طفل 30 ℅ إذا ذو الحق أصل

* طفلين 45℅ لكل واحد

مثال في حساب معاش التقاعد المنقول

متقاعد متوفي كان يتقاضى خلال حياته معاش تقاعد ( إمتياز رئيسي + علاوة الزوج المكفول) يقدر مبلغه 30.000.00دج يتم حساب المعاش المنقول على أساس هذا المبلغ و يقسم حسب الحالات الآتية :

في حالة وجود الزوج + ذو حق أخر تقدر نسبة المعاش المنقول ب 80℅ تقسم كالاتي

50℅ للزوج أي 15.000 دج
℅30 لذي الحق الأخر أي 9.000 دج
في حالة وجود الزوج و ذوي حقوق آخرين تقدر نسبة المعاش المنقول ب 90 ℅ تقسم كالأتي :

50℅ للزوج أي 15.000
℅ لذوي الحقوق الآخرين اي 12.000 دج
في حالة عدم وجود زوج و يوجد ذوي حقوق آخرين تقدر النسبة القصوى ب 90℅ تقسم بين ذوي الحقوق بالتساوي أي 27.000دج
في حالة وجود ذو حق واحد فقط تقدر نسبة المعاش ب 45℅ من معاش المؤمن له المتوفي أي 13.500دج.
