Does anyone suffer the same problem?
After having selected different objects in the layers palette, I choose "collect in new layer", but Illustrator will only group all objects from the most top layer in a new layer. That's not how it should work. Any idea?

What I normally do is I make a new layer up top.. then I select the stuff I want...
Go up top to 'Object>Arrange>Bring To Front' Shift+Ctrl+]
that clusters the stuff together at the top of my art... then I drag that (manually) into my newer empty layer.
I think what's happening in your case is you selecting stuff contained within ;layers/group..and it you notice it doesn't just 'select' the artwork (rectangle) you want but ALSO its parent (the layer or the group that houses the art)
That's what makes the 'collect in new layer' looks odd in its result (it technically IS taking the selection you made... it just not smart enough to know you didn't want the parents of the child selections.)
See here your main selection is a bigger blue box, and the part has a smaller similar selection appearance

Maybe the screenshot is missleading. I selected 3 different elements in 3 different layers and what Illustrator does. It takes the most top element in the hierarchie and groups all elements of this one layer into another layer within the elements layer. That's nonsense. I changed the screenshots so you can see what happens.

I think that's not true. Each time you select an object in an layer the layer gets marked with a small dot. Nothing else. So as i know how to work around this wrong behavior I just wanted to know if it is the same in other installations of Illustrator, too.
The way it is at the moment doesn't match the way Adobe describes how it should work (and it did work for years). See this excerpt from help:
Tip: You can move objects or layers into a new layer by selecting them and choosing Collect In New Layer from the Layers panel menu. Hold down Ctrl (Windows) or Command (Mac OS) to select nonadjacent items; hold down Shift to select adjacent items.
