I have some artwork I have done, and for a reason not in need of explaining , I want to print without using the K or black at all, I have checked every color on the design (very basic) as per attached, and the background is my second screenshot...however when I print it is still using the K in my tank as opposed to the 0% in my design, any way to get around this? The outside grey is the issue and it is 100% CMY and 0% K

That has nothing to do with AI or how you create the artwork in a broader sense. That's entirely up to your printer driver ansd using the correct color management options. How deep this level of control even goes is another matter. Since you haven't provided any specific technical info we can't even begin to tell you where to look.

Ok great start, what technical information can I provide.
I guess I was thinking if you create something in cmyk not using any K then it should print as such, but I am mistaken so let me know what I can provide you and see if we can figure it out...appreciate it.

If you are using a non Postscript printer, just about anything can happen (except what you wish).
Have you disabled/unticked anything that has anything to do with any kind of (colour) management by the printer (itself)?

Do you have the ability to get information through the printer company to see what they have to say. Web search of the make and model would be the first place to start. I have seen Epson printers where the sensor for a single ink cartrage breaks and renders the one color unusable.
