Action: stroke path Using mixer brush, doesn't Sample All Layers

-make a few layers, scribble all over them except make just a few brush strokes on one layer so the mixer brush has something to mix with on that layer but leave open areas to see mix effect from other layers
-select that layer
-make a path
-select a wet brush, with Sample All Layers on
-Stroke Path
Yay the brush mixes colors with its own and other layers.
-record an action:
--Stroke path
-(even adding other steps here like select wet brush and selecting a tool preset that sets Sample All Layers on doesnt help later)
Then
-playback the action
The path is stroked but only mixes with its own layer and not others. This is the same issue with smudge etc.

Sample All Layers seems to be turned off for actions.

I recall this being a really old issue due to actions only on a layer at a time , but this is pulling info from other layers not adding to them.
