A work path disappears when you close the file. A saved path is saved with the file.

Adding to this, there can only be one temporary Work Path in a document. A saved path can be named "Work Path", however, this doesn't make it a true Work Path. From a legacy ExtendScript perspective, a Work Path has a specific property of "PathKind.WORKPATH"

Actually, the Work Path isn't lost, but if one creates a new Work Path while one already exists, the old one is replaced as it isn't a saved path with the "PathKind.NORMALPATH" property.

 

A saved "PathKind.NORMALPATH" can also be converted to a special "PathKind.CLIPPINGPATH" (only one per document).

 

It isn't just paths that are created with the pen tool that appear in the paths panel, for example, vector shape layers can also appear here.

One can use Path Tools (set to »Path« in the Options Bar) to add to a Work Path (or a saved Path) if it is selected in the Paths Panel. 

Otherwise using the Path Tools will simply create a new Work Path and the old one is gone.

Another difference between them is that only a saved path can be used as a clipping path in InDesign, which won't see the unsaved workpath.
