Free transform reset to legacy

It has taken me a couple of years to get used to the 'new' way of doing free transform and just when I have finally trained my brain and hands NOT to hold the shift key... the latest version of PS appears to have reverted back to legacy where the shift key has to be held to maintain the aspect ratio. 

 

I have checked preferences and "use legacy free transform" is NOT set.  (I have also tried setting it and clearing the setting) Free transform is stuck in legacy mode - how do I get it back to the 'new normal'? 

 

Any suggestions?

Have you tried checking the »Maintain aspect ratio« while transforming? 

That should stick.

Have you tried checking the »Maintain aspect ratio« while transforming? 

That should stick.

Help, I am having the same problem, but I odn't know where to find "Maintain aspect ratio". I have looked all over for it.
