Legacy will not stay checked when used with brightness and contrast

I am viewing a tutorial about removing shadows

According to the tutorial the process will not work correctly unless legacy is checked in adjustments/brightness, contrast.  I have the latest version of CC

What operating system are you using?

If in photoshop you go to Help>System Info what is the version the top line says?

 

So you check Legacy and then it just unchecks itself?

My version is Adobe Photoshop Version: 21.0.2 20191122.r.57 2019/11/22: e3e4068e635 x64

Yes it unchecks itself
