Pen Tool not selecting inner paths compound paths

When using the pen tool and making a selection it only selects the outer path even when using the combine path operation. This used to work fine but hasn't worked for the last 2 versions of Photoshop.

Attached screenshot - Under the arm does have a path but hasn't been added to the selection.
