Why does the background become a layer when I use the crop tool?

I'm annoyed that photoshop creates a layer out of my background whenever I use the crop tool. I would like it to stay flat so I can simply save it again as a jpg. Is there a setting somewhere to make it not do that? I don't like the extra step of flattening the image every time I crop. Thank you!

Checkmark "Delete Cropped Pixels" in the top Option bar before you crop. It will create a single layer cropped image. What this also means is you cannot edit the crop later on.

You are right that's annoying. You could instead do the croping in CameraRaw at the image opening.
