Hallo,
wie sind die Einkünfte aus Bildverkäufen bei Adobe Stock in Deutschland zu versteuern? Habe bei der Anmeldung bei Adobe Stock das Formular W-8BEN bereits ausgefüllt, was genau ist der Zweck dieses Formulars? Was bedeutet es dass D mit USA einen Quellensteuersatz von 0 % für Bilder vereinbart haben? Ich kenne mich in der ganzen Thematik leider nicht aus. Herzlichen Dank vorab für eure Unterstützung!

I suspect it's just for their records, as required by US law. I'm no authority, so I'm just guessing. If it's not taxable in Germany, you probably won't have to pay taxes on sales.

Also wie die Einkünfte zu versteuern sind, das musst Du einen Steuerberater fragen, oder eventuell auch bei Deinem Steueramt nachfragen. Eventuell musst Du ein Kleingewerbe anmelden, die deutsche Gesetzgebung hier ist mir nich geläufig.
Das Formular bei Adobe ist nur Zuständig dafür, dass Adobe Dir den vollen Betrag Deiner Einkünfte zahlt und somit nicht in den USA versteuert werden. Dafür haben die USA mit vielen Ländern Doppelbesteuerungsabkommen geschlossen, in welchen der Steuersatz für verschiedene Aktivitäten festgesetzt wird.
Für Deutschland ist dies 0%. Das Abkommen stellt Dich aber nicht von der deutschen Einkommenssteuer frei.

In Germany, you are required to have a business license when selling stock photos. The license cost between 0 and 30€ depending on where you live. You are also required to pay taxes on your business earnings. But, because you have a business licence you can deduct your costs, such as camera, software and even internet. You must do an EÜR with your income tax (Einkommensteuer Erklärung).
The reason for the license and the tax is because this is no longer considered to be a sale from your hobby. You are trying to make a profit.
The tax treaty does not cover this type of income. If you are an american citizen (even dual) you must use the form W8 and declare the earings with a US tax filing. Regardless where you live.

If you are an American citizen, you have different rules to follow. It was always special to be an American. You can thank for this the many tax evaders you (we) have.

The basic purpose of this form is so that your earnings don't go to the IRS. There is a double tax agreement with Germany in this case, which means you don't get taxed twice. You need to declare your Adobe earnings to the German Govt though.
