License assets

Hi, 

 

I have a few questions regarding transferring a license for assets to clients. I have read in another post that in order to transfer the (standard) license to a client I have to share the additional terms with them and get their written agreement to respect those terms. And if I want to license the same asset to another client, I have to buy the asset again (and of course share the terms and let them agree as well).

 

However, I do have a couple of additional questions - 

 

* As I have an Adobe subscription some standard license - assests are free of charge. I use those in design work - reports, brochures etc for clients. This way I don't need to transfer the license, correct? (They will make the report available or print the brochure, but only in this ' end product - form'  and not use the asset on its own for other purposes). 

 

* As it is not possible to buy these free standard assets, can I still transfer the license for these assets to the client when I make them agree with the additional terms? (for example when they want to integrate some of the pictures we use in the report/brochure on on their website). 

 

* I often work for consultancies on projects for their clients. How does it work when the client of my client wishes to publish assets that we used in a report/brochure for them on their own website? For both the 'free' standard assets as well as the paid standard assets?

Free assets come with a standard licence and are to be treated like any asset under a standard licence. There is no need for a subscription to get free assets.

Incorrect. But when you do design work and you hand over the finished design, you do not need to transfer the asset. Only when transferring the asset itself, as stored on your computer, then you will need the avoid legal trouble and you want the customer to agree on the terms.

As the assets are free, let them licence them. You can't relicence free assets.

You will need a new licence for this. If they use your client's brochures and folders, that is ok. But if they host the assets on their website, they need their licence.

(Disclaimer: As always with licensing, this is my interpretation of the rules. I think they are correct and advice is based on reading and interpreting the licence terms and on fair use for both the buyer and the artist/stock company, but I cannot rule out that my interpretation is wrong. Thank you very much. So just as a recap for a specifc situation if I understand correctly. I designed a report for a consultant company who make a report on behalf of their client (and hire me for the design). For using the finished design (and me not transferring the assets itself) there is no need for a license for them at all. Now, I bought some assets to include in the report, that the consultant company now also wishes to use seperately. So in order to do so, they need to agree on the terms to me. Then, hypothetically, In case the client of the consulancy company also wishes to use those assets seperately I can purchase these files once more and let them also agree with the terms. One last question; when using standard assets (both free and paid) in the finished design, is there a need to include a statement about copywrite of the images used to make the finished design?

Your first part: 

If you hand over the finished design as a PDF file, you do not take further action. If you hand over the InDesign files with the design elements, you are handing over the source files, and then you need to take further action. For the free assets, you just need to pass over the list of the assets and they can licence on their own. 

 

Each customer needs their own licence. 

 

Crediting is needed in 2 cases:

  1. when the assets are used in an editorial sense, like on a blog or so. 
  2. when other gets credited, you need also to credit the contributors and Adobe stock.
