Stockfotos mit erweiterter Lizenz als Poster zum Verkauf im Webshop erlaubt?

Hallo zusammen,

 

ich hoffe Ihr könnt mir auf die Sprünge helfen. Ich hatte die Idee in meinem kleinem Postershop nun auch Prints von Stockfotos mit erweiterter Lizenz aufzunehmen und bin mir nicht sicher, ob dies durch die erweiterte Lizenz abgedeckt ist.

 

In einem Support-Artikel heißt es "The ownership of the image is non-transferable, hence one cannot use the image to create or publish anything in their own brand. Even if selling the images in form of t-shirts or any other customizable items with the brand name of the shop is not permissible as it removes the rights of Adobe Stock and hence a conflict."

In einem anderen wiederum steht: "Extended licenses also allow you to use the image file to create products or services that are intended for re-sale or distribution. This usage includes postcards, calendars, posters, t-shirts, print and presentation templates."

 

Ich, als Freiberufler mit einem Shop als Nebeneinkommen, habe keine wirklich brand, jedoch hat der Shop selbstverständlich einen Namen sowie ein Logo mit welchen ich auch im Social Media auftrete und werbe. Eine eingetragene Marke ist dies jedoch nicht.  

 

Was gilt nun für mich? Darf ich Stockfotos mit erw. Lizenz 1:1 als zum Verkauf bestimmte Poster/Wall Art-Motive nutzen oder eher nicht?

Du darfst Poster verkaufen, auf denen das Bild gedruckt ist, Du darfst aber nicht das Bild (JPEG-Datei) verkaufen.

To the best of my understanding, you would be able to create posters for your shop with stock images for which you purchased the Extended License.

3.3. Extended License and Specific Restrictions for Works. The license described in this section 3.3 is referred to as an “Extended License”.
(A) Extended License for Works. Under an Extended License, we grant you the same rights as under an Enhanced License, in addition to the right to use, reproduce, distribute, and display the Work:
(1) for incorporation into merchandise and template files intended for sale or distribution, without limitation on the number of reproductions or viewers, provided the recipient is only permitted to use or access the Work as incorporated into the merchandise or template; and
(2) in a press release that includes distribution of the stand-alone image file to the media, provided the Work is only published in connection with the press release, and not used or disseminated in any other manner. For clarity, and without limitation, you may use the Work in connection with (a) electronic templates and design template applications; (b) merchandise such as mugs, t-shirts, posters, and greeting cards; and (c) “print on demand” services.
