absurd denial of the alleged infringement of intellectual property rights

adobe rejected the image with word 'Decathlon', believing it to be an intellectual property infringement. If a company has named itself after a sport, then now no one has the right to use the name of that discipline decathlon in athletics? Maybe the moderator does not know about the existence of such a sport?

The decathlon is a combined event in athletics consisting of 10 track and field events. The word was formed in analogy to the word "pentathlon", from Greek δέκα (déka 'ten') and ἆθλον (áthlon 'contest, prize'). Events are held over two consecutive days and the winners are determined by the combined performance in all. Performance is judged on a points system in each event, not by the position achieved. The decathlon is contested mainly by male athletes, while female athletes typically compete in the heptathlon.

Decathlon is a French franchise for sports articles.

I'm afraid it will come under IP. It is the name of a sports shop that is common in Europe.

It is the same as "Apple'. If you use 'Apple' as a name, it will be rejected, even though it is also the name of a fruit.

Unfortunately, one has to be careful these days in how common names are coming under IP, and are registered trademarks!

So, it will depend on how you use the word. In this case, the area could be tricky.

In Deutschland ist es auch komplizierter geworden, da das Urheberrecht für Ansichten von Gebäuden oder Eigentum im Jahr 2019 verändert wurde. Das einzigste was frei blieb, ist das freie Recht auf Panorama für derartige Objekte. Bedeutet, bei der Bezeichnung des Fotos und bei den Schlagworten sollte man dieses Entwicklung unbedingt beachten. Ansonsten, Ablehnung von Adobe-Stock. Ein ähnliches oder gleiches Problem sollte der Eröffner dieses Threads haben.

Die Panoramafreiheit war nie Bestandteil des juristischen Vokabulars bei Adobe stock. Anders gesagt, es gibt sie nicht. Und der Architekt hatte schon immer besondere Rechte über die Verwertung seiner Kreationen. Ich habe in meiner beruflichen Karriere viele Gebäude fotografiert, da wir Projektentwickler sind, und an diesen Gebäuden mitgearbeitet haben. Natürlich dürfen wir die Bilder für unsere Werbezwecke nutzen, aber der Architekt hat ein Recht auf Namensnennung. In der Regel haben wir eng mit dem Architekten zusammen gearbeitet, und sein Interesse liegt natürlich daran, dass er für spätere Projekte von den eventuellen Bauherren berücksichtigt wird. Und da wir die Projektabwickler im Namen des Bauherrn sind...

 

Das ist natürlich nicht bei bei Stock gegeben, und der Architekt kontroliert hier auch nicht die Nutzung seines Werks. Die Welt ist kompliziert. Blümchen benötigen keine Freigabe... derzeit, Skylines erstaunlicher Weise auch nicht..

According to Google, the word Decathlon is trademarked by a French sporting goods retailer.

This retailer can only claim its unique logo and its own design for the spelling Decathlon, not the word Decathlon at all. Here is their company name design:

"Yes, the WORD Decathlon is trademarked by the French sporting goods retailer of the same name. However, trademark rights are specific to certain industries, meaning the word can still be used for other purposes, such as referring to the 10-event track and field competition. "

 

Which means, as far as Adobe is concerned, the word can't be used commercially. (See my signature 🙂 )

Tricky question! What technically you're correct, the word decathlon does not have a trademark protection, but it could have some kind of "protection" that Adobestock would not want to deal with.... such as decathlon.com

Have you submitted other similar word designs like:

race, triathlon, tournament?  What I would do is submit a bunch of these at the same time and see what happens.

Perhaps it's also time for you to consider other stock platforms

Adobe accepted my illustrations with the words triathlon, pentathlon and other names of sports - rugby, football, soccer, volleyball, baseball, golf, handball, etc. But the word decathlon - no

As I said, decathlon is trademarked. It's the name of a French sports store chain.
