Account verification retaliation

I submitted a request to Adobe about their rejection of a minor amount of photos of mine due to needing a property release. It was quite amusing to me that they required this for these photos. They were not only AI generated, but they were not of any recognizable person, obviously artistic, and were tagged correctly as AI.

 

I was very respectful in my contacting of them. When I got a response this was what it was:

Dear Andrew,
 

Any content created with generative AI tools that depict, is based on, or is intended to portray an identifiable person requires a model release

If the generative AI content is not based on a real person, but it visually appears to resemble a person, then you must submit a property release confirming that you have all property rights in the content.

I find this quite amusing.

Shall I inquire with the AI to fill out this form?

 

I know all of this is really new for everyone. But when I submitted this question to them, and had this response, and subsequently I rated their service as BAD, my account, the very next day, was blocked.

 

I do not see that as a coincidence.

Also, I had almost 4,000 photos/illustrations on there. Most of the money I have made in fact so far, has been from photos I have taken.

 

I find not only the customer service terrible, but I also find the way I am treated as a contributor terrible.

If my account never sees the light of day again they will have taken with them many valuable hours/days/weeks of my time.

 

But I suppose that is to be expected from the same company who forced all of its users over to the subscription base platform.

Judging from personal experience I can confidently say it was not because of your reaching out to them about the MR request. I have not seen the content of your request, therefore I cannot say if the content had anything to do with it, but I would want to believe that it has to do with your account and not you. I believe whatever the problem is might have been there for a while and when you send in the request the agent looked in your account and see it. In other words, if you did come to the forum first the issue would have been discovered at a later date. I suggest if you did not get the mail that you reach out to them via the link on your account page.

 

When you register to start submitting you agreed to submit property release for all property you submit including your personal property. I cannot understand why you would not want to submit a property release for your own work. All you have to do is to fill out the form as owner and artist, submit it and attach all the affected file. You dont't need to use a printed form. You just use the electronic method that eliminates the use of witnesses.

 

I believe you were asked to submit MR because they're images of people. There is no way the moderator could know they are not real. So if you're asked for MR; you know they're not real; you provide PR. It's as simple as that.

As I said above I have no issue with submitting the form. I just found it strange at first, for AI stuff. This is why I initially reached out to them. 24 hours later my account is banned. Then I post this thread. A few hours later I receive an email emphatically telling me I'm not being retaliated against. According to Mat Hayward this is regarding some metadata on my portfolio submissions. I just find the timing of all this too coincidental and I would have appreciated Adobe having reached out to me as politely as I did to them. But I am just another cog in the wheel I suppose.

 

Whatever they need for me to comply with their standards I am fine with.

Did you title, keyword and describe your AI images as "Generative AI Illustration?"  That's important so customers know exactly what they're paying for.

It appears that, due to ongoing complaints from Buyers, Adobe is routinely pausing accounts with Generative AI assets that do not comply with the guidelines for category, titles, keywords and releases. You should have received an email indicating that your account was suspended, and what you can do about it. I have no reason to think that Adobe would retaliate against Contributors, especially one like yourself who has been on the platform for a while and from whom they're generating revenue.

Adobe may temporarily suspend or permanently terminate a Stock Contributor account for any of the following:
1) Suspicious sales or refund activity (possible shenanigans),
2) They received an official infringement complaint or "take down" notice from a 3rd party.
3) Suspected violation of Stock Contributor User Terms,

4) Spamming the system with junk content,
5) A technical problem that only Stock Support can fix.

I will not argue with the property release policy if that's what is expected. Let's hope that's all this is.

Don't be silly.  Simply sign a Property Release by you as the "artist" (I use that word loosely because a toddler could create a text-prompt). 

 

Generative AI requires no artistic talent. It's what you do with AI diffusions afterwards that elevate them from digital dust to artwork.  😉

 

If you're not incorporating AI into your own artwork, then you have another problem.  According to U.S. Copyright rules, non-human generated content cannot be copyright protected.
