Can this image considered commercial or Illustrative Editorial?

Design patents aside, it's not good enough for commercial use due to poor image quality.

But to answer your question, elevator door buttons, including "open/close door" buttons, are considered protected property.

You would need a signed property release from the maker.

It would qualify as a standard commercial asset, but the quality of the asset is even not near to what is required. Submitting such a picture here let's me think that you do not qualify for submitting illustrative editorial assets as you would need to have a minimum of 100 lifetime sales. Having 100 sales would suppose a certain experience for the quality issues with assets, which this asset clearly does not show:

  • crooked white balance.
  • bad framing
  • not level
  • probably also underexposed
  • and probably still some other errors.

It doesn't meet the criteria for Illustrative Editorial. I think it will be rejected for quality issues. Not well composed and white balance issue.
