Confused about AI-generated art needing a model release
I submitted a piece of AI-generated art a while back, and got my first communication regarding it today. I was informed that my submission is pending, subject to taking additional needed action. Specifically, I am told I must submit a model release.
The art is of a woman's head. It is photorealistic and does look like an actual person, but the person is completely imaginary. When submitting it, I checked the box signifiying that it was AI-generated. I also completed and uploaded a property release in my name.
Adobe's own guidelines state: "If the generative AI content was not based on a real person, but it visually appears to resemble a person, then you must submit a property release confirming that you have all property rights in the content."
I don't know what else I can do. Obviously, I can't get a model release from an imaginary person. And Adobe does have my property release as well as my acknowledgement that it is AI-generated art.
