generative AI with people in

Hi Everyone,

I have a question about generative AI with people in.

Here is the guidline what I read online:

If that person was completely written prompt generated and is not based on a real person in any way, then a PROPERTY release is required. If the person was created with a prompt (either visual or written) that is based on a real person, then a MODEL release is required. 

If I write a propmt like this : a photo of a 20 years young guy playing soccer, and I don't give any images as referrence. Shall I only provide model release for the image or only property realease? I don"t really understand the sentence If that person was completely written prompt generated and is not based on a real person in any way. Is it means i only write prompt and don"t provide any image with real people, or I have to make sure AI also doesn"t generate this image base on real person?

    Thank you for your answer Ralph! Like you said, there is no way of kowning what AI uses...quite scary. One of my friends uploaded the images to google image and check if there are similar image on the search engin. If google image can't scan any similar images, it might quite 'safe', but still not 100% sure....that's the problem...

    AI draws from a massive data bank of people, places and things.  It's unlikely that it will construct a recognizable human from a generic text prompt unless you trained it with specific names of celebrities or actual human photos. 

     

    Don't sweat the small stuff.  Focus on quality. Generate high resolution diffusions and examine assets closely. AI is notoriously bad at details & geometry. 

     

    Fake people = property release signed by you as creator of the AI.

    Real people = model release signed by the human it is based on.

      Thank you Nancy! Yes, although V5 of midjourney has a big improvement of image quality, but there are still many small logical mistakes in like 4 fingers or wrong overlap. But it can be a great source of inspiration 🙂

          In such a case a property release. If the person is identifiable by the moderator, it will get refused.

          If a real person identifies himself, you may be facing legal issues. You have no way of knowing what AI uses as a template.
