I get so confused when reading the verbiage.

Would a building under construction be consider copyright infringment?

Not necessarily unless it is covered in builder's signs or product logos; however this one would surely be rejected as too blurry.

No, but you may need a property release.

But I would guess that this picture would also have some quality issues.
