Some decisions on intellectual. property seem strange,  

This photo that I submitted they wanted a signed release from the subject. How do I get a penguin to sign a release

And IP refusal is not asking for a model release. The image is too small for checking it, but the reason may lie in a small logo that is visible somewhere. Or it may be indeed that the location needs to get a property release. I agree, however, with @Ricky336, the asset has also issues independent of this refusal reason.

Even though it was taken at a public place - who knows because, from the pic, it might well have been taken at a zoo! It doesn't look like it was taken in the 'wild'. Framing the bird without the 'garden like' background might help.

However, with this pic, there are other quality issues as well.

It's a pelican, not a penguin. I agree that the wrong rejection reason was probably selected. It happens.

The moderator may have accidentally selected the wrong reason for the rejection. Without seeing the full-sized image as submitted, there may be other issues at play here. Composition, the distracting background, etc.

It could be that this pic was taken at a zoo.  That might be an issue right there.  Lots of zoos have a policy of no picture taking for commercial use.

No the picture was not taken in a a zoo. But in a public place near the lake in Adelaide
