You need to check that with the information at your disposal. It may be release free, it may be that it is not at all allowed to get photographed. It may be that you need a licence to photograph, it may be that you can photograph, but not for commercial use. You have many options.

In addition, you will need a model release from every person in your picture, that may be recognizable.

One of--if not THE one--that brought this property release issue to the point where it is today is the story by a photographer I was fortunate enough to be in attendance at during one of his lectures. This was a good 25 years ago where I heard the lecture, the the issue itself probably occurred 5 or more years earlier.

He photographed a very popular lighthouse near Rockport, Maine and mass produced a calendar where the image appeared in one of the months of the calendar. The owner of the lighthouse came across the calendar by chance and filed a lawsuit asking for a percentage of the profits the photographer made from the sale of the calendar. That is, he didn't sue for an arbitrary amount, he just felt he was owed a percentage of the profits from sales, which was mutually agreed upon and the matter was settled. So no...whether a painting or photo, you'd be taking a chance, and most certain so would Adobe. Get a property release.

Property releases must be obtained from the legal owner of the building.
