AI generated character(s) accidentally resembling real life people

Hi,

what if you use an AI-generated, cinematic quality actor for professional work, and then somebody finds out it accidentally resembles somebody who really exists somewhere in the world? Is a standard disclaimer specifying that "all characters are digitally generated and any resemblance with real people is accidental" enough to avoid a lawsuit?

I suppose that can happen. In fact, it happened to me. But unless the individual was depicted in a compromising situation, it's not likely it would be an issue. We all have our doppelgängers after all. I once produced an image that looked virtually identical to a close friend of mine, even though she had no internet presence, so it couldn't have been an issue of her likeness being trained for AI. It can also depend on the prompt. Prompting something along the lines of "a famous female movie actor" could conceivably rely on creating an image of an actual person. So try not to be too specific. Of course, if you are producing AI as an employee for a company, they may require such disclaimers like your example. Anyway, none of this is legal advice and I'm no lawyer.
