Usage of Firefly generated image through customer

We created a Christmas card with a Firefly image for a customer and used credits for it. The customer wants to provide this graphic to another agency so that they can create an online marketing campaign. Can the customer continue to use the graphic or how can they purchase licenses?

I am not an attorney and cannot provide legal advice. 

 

For any of the products using generative AI features (such as Firefly web site, Ilustrator, Photoshop, Adobe Express) these are the guidelines for use: Adobe Generative AI User Guidelines.  These guidelines say that content created with generative AI features can be used for commercial use unless the product is in beta and it says it cannot be used for commercial use.  One thing to note is if you are using the free Firefly plan, you cannot remove or crop out the watermark, even if your use is noncommercial/personal only. 

 

I think a reasonable interpretation of these guidelines is if you generate an image and give it to someone else, they do not have to pay for or license the image from Adobe. There might be other intellectual property issues in the use of the image in the marketing campaign. For those, it is best to consult legal counsel.
